HAVi

Technical Information/Licensing Information...

Intellectual Property Rights licenses are available from the companies that contributed to the HAVi 1.0 specification.

The seven of the eight promoter companies (Grundig, Hitachi, Matsushita including JVC as Matsushita's group member, Philips, Sharp, Sony and Toshiba) who have co-created the HAVi Specification enable smooth and easy access to their IPR, which protects the HAVi Specification, by an open Joint-License program via Philips, as Licensor, on non-discriminatory most favourable terms and conditions.

The relevant IPR includes:
  1. the HAVi Specification;
  2. Essential Patents, which are deemed to be necessary for the manufacture of HAVi Products, that comply with the HAVi Specification;
  3. the HAVi logo, the use of which is allowed for the promotion and sales of HAVi Products and
  4. HAVi Compliance Test Suite and HAVi Test Requirements, which are prescriptions for testing certain aspects of implementation of the HAVi Specification in products.
Under the license the right is granted to use the HAVi Specification, the HAVi TestSuite, the HAVi Test Requirements and the Essential Patents to manufacture either
  1. HAVi End Products or HAVi Interfaces (i.c. Software/Hardware, which makes an electronic device work as a HAVi EndProduct), which are to be sold for use as such by an End-User, or
  2. Intermediate HAVi Products, which are supplied to HAVi End Products manufacturers, to manufacture HAVi EndProducts.
The HAVi End Products or HAVi Interfaces are fully licensed products and a royalty of US$0.10 is due to be paid. The license for Intermediate HAVi Products is limited. As a consequence the Intermediate HAVi Products can only be supplied to Licensees for the manufacture of HAVi End Products. However, no royalties are due for Intermediate HAVi Products. The right to use the Logo is limited to the use on HAVi End Products, Intermediate HAVi Products as well as HAVi Interfaces including packaging and promotional materials for such Products and Interfaces.

Upon conclusion of the HAVi License Agreement, and upon payment of an initial fee (non refundable) of US$5,000 the Licensor will have available for Licensee:
  1. The HAVi Specification;
  2. The artwork of and user guidelines for the HAVi Logo and
  3. The HAVi Test Suite and HAVi Test Requirements.
Further Licensee has to agree to license its patents, if deemed essential for products to comply with the HAVi Specification, under terms and conditions comparable to those of the HAVi License Agreement to the Group of Seven Companies, their Associated Companies, and to any other Licensee under the HAVi License Agreement.

The term of the License Agreement is 10 years, which can be extended upon request of Licensee to Licensor.
